A global settlement occurs when a defendant – often a large corporation – must settle with multiple plaintiffs.

If you’re the person getting the full 10,000, they can be bad if you’re, you know, a number much, much lower in line with less severe injuries. So, um, it’s a, it’s a, it’s a catch 22 at these global settlements, but that is a global settlement for a car accident case. And it doesn’t mean that it has to be in litigation. You don’t have to file a lawsuit. If the insurance company determines that that global settlement needs to occur immediately, they’ll set it up immediately. So in any event, hopefully that explains what a global settlement in a car accident claim is and how it works.

If there's a settlement, it will apply to all members of the class (unless they've taken steps to opt out). The judge must approve the settlement as adequate and fair to the class members. However, the injuries caused by some defective or dangerous products can be very different from one person to the next.

Can you be bound by a global MDL settlement?
You won't be bound by a global MDL settlement unless you agree to it. (Usually, a certain percentage of plaintiffs have to opt in to a proposed settlement before any money will be paid out.) If you opt in, you'll receive an amount out of the settlement funds based on a formula that takes into account your individual circumstances, especially the extent of your damages. Normally, you'll see the formula in advance, so you can estimate how much you would receive before you decide whether to be part of the settlement.
