Is Huawei settling with MPEG LA?
Huawei and MPEG LA have now settled their dispute before the Düsseldorf Patent Court. According to sources close to both companies the mobile phone manufacturer and patent pool signed an agreement this morning, formally ending the sales ban on Huawei mobile phones in Germany. Sources claim a settlement between MPEG LA and ZTE is also imminent.
Does ZTE sell in Germany?
The settlement with Huawei also increases pressure on another Chinese mobile phone manufacturer. ZTE has not sold any devices in Germany since Christmas, when MPEG LA enforced four judgments of patent infringement from the Regional Court Düsseldorf.
Supreme speculation
Almost three years on, the case in London is at an advanced stage. The Supreme Court heard the case in November, with a verdict expected in January. But it could be the case that Unwired Planet and Huawei settle before the judgment is released. Here, patent experts are unsure what will happen.
German judgment expected
In Germany, too, Unwired Planet and Huawei are awaiting a ruling from the highest court. In October, the Federal Court of Justice declared the patent valid in the final instance. It has paved the way for a decision on whether Huawei’s mobile phones infringe the patent. Furthermore, it will also decide on whether both parties are FRAND-compliant.
